Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the TradesTalent Systems platform and related services (the “Service”) provided by TradesTalent Systems (“TradesTalent,” “we,” “us”). By creating an account or using the Service, you (“Customer”) agree to these Terms.

1. The Service

TradesTalent provides a recruiting operations platform that helps recruiting and staffing businesses capture leads, manage candidates, schedule interviews, and automate outreach. We may update, improve, or modify the Service over time.

2. Accounts

You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be authorized to act on behalf of your organization.

3. Acceptable use

You agree not to misuse the Service, including by violating any law, infringing others' rights, attempting to gain unauthorized access, or interfering with the Service's operation or security.

4. Customer data and license

“Customer Data” means data you submit to or generate through the Service, including candidate, lead, interview, placement, and performance data. As between the parties, you retain ownership of your Customer Data.

You grant TradesTalent a worldwide, non-exclusive license to host, store, process, transmit, and display Customer Data as needed to provide the Service, and to use Customer Data to operate, develop, train, and improve the Service and its features (including artificial-intelligence and analytics features). You further agree that TradesTalent may create and use de-identified and aggregated data derived from Customer Data — which does not identify you, your organization, or any individual — for any lawful business purpose, including improving the Service and producing benchmarks and insights, and that TradesTalent may retain such de-identified and aggregated data.

You represent and warrant that you have all rights, permissions, and consents necessary to provide Customer Data to the Service and to grant the licenses and permit the uses described in these Terms and our Privacy Policy.

5. Third-party integrations

The Service integrates with third-party services (such as Meta and Google) that you choose to connect. Your use of those services is governed by their terms, and you are responsible for maintaining the rights and permissions required to use them through the Service.

6. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose.

7. Limitation of liability

To the fullest extent permitted by law, TradesTalent will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data. Our total liability for any claim relating to the Service will not exceed the amounts you paid us in the twelve months before the claim.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or as required by law. De-identified and aggregated data may be retained as described above.

9. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules.
